HANDSHAKE PRIVACY POLICY

Handshake App Inc (“Handshake”, “we”, “us” or “our”) is committed to your privacy. This Privacy Policy explains what personal information we collect, how we handle it, and the privacy rights you may have.

“Personal information” or “your information” means information that is about an individual that can be identified. It does not include information about a business or anonymized information.

“Business customer” means our client that uses our AI assistant services for their business. We don’t provide our services directly to you, the end user, but you may interact with our AI assistant or other aspects of our services (as described in more detail below) when you interact with our business customers.

When this Policy Applies

This Privacy Policy applies whenever you interact with us directly, or when someone else (such as our business customers) provides us with your information. If you have any questions regarding the Privacy Policy, you can submit them using the information provided at the end of this Policy under “Contact Us”.

Since we do not provide our services directly to individuals, you have likely encountered us because one of our business customers (for example, a store that you shop at) uses our AI assistant services (the “Services”) to interact with you. The personal information that you provide to our business customers in your phone and email interactions with the AI assistant may be made available to us if they have the Services enabled. We then process this information on the business customers’ behalf to provide the Services to them.

Please note that we are not responsible for how our business customers handle your personal information, including how and to what extent they make your personal information available to us by enabling and configuring the Services. Any handling of your personal information by our business customers will be governed by their respective privacy policies and/or practices. Our business customers are responsible for notifying you and/or obtaining your consent regarding their use of our Services before enabling our Services and making your information available to us.

How We Handle Your Personal Information

Types of personal information we collect

We may collect the following types of information directly from you:

  • Feedback or correspondence: this includes any information you provide us when you contact us with questions, feedback, reviews, or otherwise communicate with us.
  • Online activity information: this includes information about your device, how you use and browse our website, and your IP address, which we obtain from your online interactions with us. See “Interacting with us online” below for details.

We also receive personal information from you via our business customers when they have the Services enabled. The types of information we receive will depend on how our business customers use the Services, but can include the following:

  • Information provided during interactions: This includes information about yourself you provide to the business when they have the Services enabled. This will include your name and contact information (such as phone number an email address), and may include additional information you provide voluntarily during the interaction, such as details regarding your transactions with the business. This applies to both phone and email interactions with the AI assistant.

Please note that our Services are not intended to collect sensitive personal information like your financial details during your interactions with the AI assistant.

  • Recordings and transcripts: This includes recordings and transcripts of your phone calls with the AI assistant when our business customers have the Services enabled.

What we do with your information

We may use personal information to:

  • Provide and support the Services. This includes operating, maintaining, evaluating, monitoring and delivering the Services to our business customers.
  • Improve and market our Services. This includes improving our Services (including at times improving and training the underlying AI models) based on collected data, customizing our Services, identifying usage trends, developing new products and services, and related data analytics. Any information used for model training or related marketing and analytics purposes will be aggregated and de-identified, so that it can no longer identify any specific individual
  • Communicate with you. This includes responding to your requests, questions, feedback, or other communications.
  • Protect you and us. This includes investigating and protecting against fraudulent, harmful, unauthorized, or illegal activity, complying with legal and regulatory requirements, and protecting our property (including the Services), interests, and legal rights.
  • Assess and engage in business transactions. This includes the evaluation and execution of the purchase or sale of all or part of a business or its assets.

Sharing your information

Our business customers. We collect information about your interactions with the AI assistant (as set out above) on behalf of our business customers when they have the Services enabled. As part of the Services, we then process and share information about these interactions with our business customers. This includes descriptions, summaries, and analytics related to the nature, content, tone, and frequency of your interactions with the business customer through the AI assistant. It may also include call recordings and transcripts of your phone calls.

Affiliates and service providers. To perform the activities mentioned above, we may share information with our affiliates as well as third parties to perform services on our behalf. We use service providers to perform the following functions:

  • Support certain aspects of the Services, such as performing analytics, including sentiment analysis, on phone and email interactions facilitated by the Services—for example, providers of other AI tools that are used in our Services, including Bland and Retell AI.
  • Assist with IT functions, such as implementing, operating and protecting our Services and other IT assets.
  • Obtain professional advice and services, such as from lawyers or accountants.

Other third parties. We may share your personal information with other third parties to:

  • Protect you and us. This includes investigating and protecting against fraudulent, harmful, unauthorized or illegal activity, complying with legal and regulatory requirements, and protecting our property (including the Services), interests, and legal rights. It also includes responding to requests for information received from government agencies, regulators, or law enforcement that we determine to be legitimate.
  • Assess and engage in business transactions. This includes the evaluation and execution of the purchase or sale of all or part of a business or its assets.
  • Any other person or organization with your direction or consent.

Interacting with us online

Cookies and similar technologies

We use certain technologies and tracking tools on our website and app, such as cookies. Cookies are snippets of data stored by a web browser (for example, Chrome, Safari or Firefox web browsers). We may also use pixels, beacons, web analytics services, and other technologies. These tools provide us with information about your usage of our Services. This information helps us operate, improve and protect our Services.

We, and third parties we permit, may use these tools to track which of our ads you interact with on our website and on the websites of companies who help us advertise. We may use this information for analytics and reporting, to learn more about how you interact with us, and/or promote our products and services.

Web analytics

We use Google Analytics to better understand your use of our website. Google Analytics collects information on user behaviour on our website, which includes how many times a user visits our website, what pages they visit, and where they were referred from. Advertising identifiers for mobile devices are also collected. Google may use the data collected for its own purposes, including to contextualize and personalize the ads of its own advertising network.

Your cookies choices

You can choose to accept or decline cookies within your web browser. Different browsers make different controls available to you. Generally, your browser’s settings or “Help” function will let you accept, refuse or delete cookies. Each browser’s website should contain instructions on how you can do this.

If you delete or refuse certain cookies, please be aware that it may prevent you from obtaining certain content, features, services, products, or benefits of the Websites.

Our Privacy Practices

How we protect your information

We have implemented safeguards designed to protect your personal information against unauthorized access, use, modification and disclosure. Only authorized personnel have access to your information. We also have technical and organizational security measures designed to protect the security of any personal information we handle, as well as practices for the destruction and retention of your information (see “Destruction and retention” below) and the handling of privacy-related questions, requests and complaints (see “Your Choices” and “Contact Us” below).

International transfers and storage

Some of our service providers may be located outside of your region. As such, we may store, access, or transfer your information outside of your home province, state, or country, and your information may be subject to the laws of these jurisdictions. This means that, just like in your home jurisdiction, we or a third party may be required to disclose your information in response to valid demands or requests made by governments, regulators, courts and law enforcement authorities in these other jurisdictions.

Destruction and retention

We retain your information only as long as we need it for the purposes we collected it, or otherwise as required or permitted by law.

We have procedures to guide what we do when we no longer need your information for these purposes. We may securely destroy, delete, erase it, or convert it to an anonymous form.

Automated decisions

We do not make any automated decisions about end users that interact with the Services through our business customers. However, our business customers’ use of the Services may result in some automated decisions being made based on the information provided to the AI assistant during an interaction. For example, a caller asking about a particular product may result in a decision to recommend a similar product to them.

Though we are not responsible for how our business customers use the Services, the Services are not intended to allow businesses to make important decisions about you, the end user, without human oversight. As noted above, our business customers are responsible for communicating to you about their use of the Services, including, if applicable, information about any decisions they make about you based on your interactions with them when they have the Services enabled.

Children

Our Services are not intended for children and we do not knowingly handle personal information about anyone under 14 years of age. If you think we may be handling personal information about anyone under 14, please contact us immediately using the information below.

Your Choices

Subject to legal, business or contract requirements, you can withdraw your consent to our collection, use and sharing of information at any time by giving us reasonable notice. However, withdrawing your consent may limit your ability to access certain Services, like the Website.

Some other choices you have include:

  • Unsubscribing from marketing or promotional emails
  • Managing your cookies preferences (see “Interacting with us online” above)
  • Telling us about your other communication preferences

In certain circumstances, your consent cannot be withdrawn. For example, you may not withdraw your consent where our collection, use and sharing is permitted or required by law, is required to ensure we have correct and up-to-date information about you, such as your current address, or is necessary to manage our business, including the sharing of information when we assign our rights to others for business transactions.

In addition to exercising your privacy choices above, you can request to access or correct your personal information, ask questions about our privacy practices, or submit a complaint. Users in other jurisdictions may have additional privacy rights.
